1. Introduction

Welcome to ScaleNest FZ LLE ("we," "us," "our," or "the Company"). We are an e-commerce business operating from the United Arab Emirates, specializing in personalized apparel, professional and personal accessories, stickers, temporary tattoos, and home decor.

These Terms of Service ("Terms") govern your access to and use of the website located at www.MyInkFlare.com (the "Site"), including the purchase of our products (the "Products"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree to all these Terms, you may not access the Site or use our services.

2. Eligibility and Account Security

• Age Requirement: You must be at least 18 years of age, or the age of majority in your jurisdiction, to use this Site or purchase Products. By purchasing items intended for children, you represent that you are a parent or legal guardian acting on their behalf.

• Account Accuracy: If you create an account, you warrant that all information provided is accurate, complete, and current. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Nature of Our Products

ScaleNest utilizes a Print-on-Demand business model. This means our Products are not held in pre-existing inventory; rather, they are manufactured specifically for you only after an order is placed. By purchasing from us, you acknowledge and agree to the following:

• Production Time: Items require a manufacturing period before they are shipped. Please refer to our Shipping Policy for estimated production and delivery times.

• Inherent Variations: Because each item is printed individually, slight variations in color vibrancy, print placement, and fabric texture may occur. These minor variations are a natural characteristic of the POD process and do not constitute a defect or grounds for a refund.

4. Products, Pricing, and Payments

• Product Descriptions: We strive to display the colors, designs, and details of our Products as accurately as possible. However, we cannot guarantee that your computer or mobile device's monitor display of any color will be perfectly accurate.

• Pricing & Currency: All prices are listed in USD. We reserve the right to change prices at any time without prior notice.

• Taxes and Customs Duties (International Orders): Your order may be manufactured and shipped from a facility located in a different country, depending on your shipping destination and product availability. Because the country of origin may vary, the price you pay at checkout will not include international import duties, value-added taxes (VAT), or customs clearance fees. You, the customer, are solely responsible for paying any additional customs duties, taxes imposed by your local government or the shipping origin country. ScaleNest has no control over these localized charges; cannot predict their exact amounts, and will not issue refunds for orders refused or abandoned due to unpaid customs fees.

• Payment: Payment must be authorized and completed in full before your order is sent to production.

5. Orders, Cancellations, and Modifications

Because our Products are custom-made to order, our production partners begin processing your item almost immediately after checkout.

• Cancellation Window: You may request to cancel or modify your order only within 12 hours of placing it. Once this window has passed, or once the order status changes to "In Production," the order cannot be canceled or modified.

• Right to Refuse: We reserve the right, at our sole discretion, to limit or cancel quantities purchased, refuse an order, or suspend your account if we suspect fraudulent activity, pricing errors, or a breach of these Terms.

6. Shipping and Delivery

• Shipping Addresses: You are solely responsible for providing a complete, accurate, and deliverable shipping address that includes all information required by courier services (e.g., street number, building name, apartment/unit, city, state/province, postal code, and country). We are not liable for delays, missed deliveries, or losses resulting from incorrect, incomplete, or illegible address information. Any reshipping costs due to customer address errors will be borne by you.

• Delivery Estimates: Shipping times provided according to our shipping policy are estimates based on historical data and carrier projections. They are not guaranteed delivery dates. ScaleNest is not liable for delays caused by the shipping carrier, customs processing, weather events, or global supply chain disruptions.

• Lost or Stolen Packages: Once the tracking system marks a package as "Delivered," ScaleNest is not responsible for lost or stolen items. Please ensure your shipping address is correct and secure.

7. Returns, Refunds, and Exchanges

Due to the custom, made-to-order nature of our Products, all sales are final. We do not accept returns or offer refunds for "change of mind," incorrect sizing selected by the customer, wrong delivery address provided or color discrepancies caused by screen settings.

Therefore, you can cancel and receive a full refund for orders before they are in production. Once in production we can no longer guarantee a cancellation and you will be charged for the product costs.

In order to exercise your right of cancellation, you must inform us of your decision by means of a clear statement. You can inform us of your decision by e-mail myinkflare@scalenest.ae

We will reimburse you no later than 30 days from the day on which we receive your cancellation request. We will use the same means of payment as you used for the order, and you will not incur any fees for such reimbursement.

We do not accept returns of unwanted items. However, in cases where items are damaged or incorrect, you can send us proofs (ex. product images) for further investigation.

If there is an error on our part, we will handle the return and refund at our own expense. However, returns for a refund for any other reason, such as a change of mind or a problem not related to our service will not be accepted.

We always recommend a choosing trackable mail service specially for high value orders. While we will do our best to ensure best fulfillment experience in cases of lost deliveries due to not providing complete address or wrong address we are unable to issue a refund. its your responsibility as a buyer to ensure accurate and full delivery address details.

In case you have not received your order within 30 business days despite providing correct address, then let us know and we are happy to arrange a replacement on our expense.

Conditions for returns

In order for the goods to be eligible for a return, please make sure that:

• The order placed was purchased in the last 30 days.

• The goods are in the original packaging.

The following goods cannot be returned:

• The supply of goods made to your specifications or clearly personalized.

• The supply of goods which according to their nature are not suitable to be returned, for example goods which deteriorate rapidly or where the date of expiry is over.

• The supply of goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

• The supply of goods which are, after delivery, according to their nature, inseparably mixed with other items.

We reserve the right to refuse returns of any merchandise that does not meet the above return conditions at our sole discretion.

8. Product Safety and Specific Disclaimers

• Temporary Tattoos & Stickers: Our temporary tattoos and adhesive products are intended for novelty and decorative use. We strongly recommend performing a patch test on a small area of skin before full application. Discontinue use immediately if redness, irritation, or allergic reactions occur. ScaleNest is not liable for adverse skin reactions.

• Children’s Products: Our apparel and decor items for kids are designed with safety in mind, but they are not toys. Parental supervision is recommended, particularly for items with small parts (like stickers or accessories) that could pose a choking hazard to young children.

9. Intellectual Property Rights

All content on the site is the property of ScaleNest FZ LLE or its content suppliers and is protected by international copyright and intellectual property laws. You may not reproduce, duplicate, copy, sell, or exploit any portion of the Site's content without express written permission from us.

10. Prohibited Uses

You agree not to use the Site:

• For any unlawful purpose or to solicit others to perform or participate in unlawful acts.

• To violate any international, federal, provincial, or state regulations, rules, or laws.

• To infringe upon or violate our intellectual property rights or the intellectual property rights of others.

• To submit false or misleading information, upload viruses, or interfere with the security features of the Site.

11. Limitation of Liability

To the maximum extent permitted by applicable law, ScaleNest FZ LLE, its directors, employees, partners, agents, suppliers, and third-party POD fulfillment providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Site or Products.

12. Indemnification

You agree to defend, indemnify, and hold harmless ScaleNest and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates (UAE), specifically the laws of the Emirate of Fujairah, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the courts of the UAE. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

14. Changes to These Terms

We reserve the right to update, change, or replace any part of these Terms by posting updates and/or changes to our Site. It is your responsibility to check this page periodically for changes. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.
